Telephone marriage or video marriage

Proxy Marriage

(1) What is a Proxy Marriage?
A proxy marriage is when one or both partners are not physically present at the marriage ceremony. For instance, if the ceremony were held over Zoom, that would be a proxy marriage.

(2) Does USCIS recognize Proxy Marriage or video or telephone marriage?
Yes, however, there are two requirements.
The marriage must follow the “place of celebration” rule. In other words, it must be valid under the legal jurisdiction it was performed in.
The couple must consummate the marriage. This requires them to be physically together after the proxy marriage.

(3) How can I prove proxy marriage?
To prove a proxy marriage, the couple must be able to indicate that the marriage is valid under the jurisdiction it was performed and that the marriage was consummated.

To prove the marriage’s validity, usually, a marriage certificate will suffice. However, it is important to note that not every state allows for proxy marriages, or they may have different requirements regarding them.

To prove that the marriage has been consummated, affidavits can be included as well as documentation that proves both partners were in the same place at the same time (ex: plane tickets, photos taken together). In addition, if any children were produced from the marriage, that would be ample evidence. It is also advisable to include ample evidence that proves the marriage is genuine.

(4) Should I do a proxy marriage?
If possible, it is best to undergo a traditional marriage where both partners are present, however, if both partners cannot be present, then a proxy marriage may be a possible alternative.

(5) Is the K-1 Fiancé visa a good alternative to Proxy marriage?
The K-1 Fiancé visa is a suitable option if it is difficult for one of the partners to travel. This option would allow the alien partner to enter the U.S. on the basis that the couple will get married within 90 days, whereupon they can then apply for a green card.
