What is a U visa?
The U visa is for victims of certain serious crimes who have suffered mental or physical harm and are helpful to law enforcement in investigating or prosecuting the crime.
What crimes qualify for a U visa?
Qualifying crimes include:
- Domestic violence
- Sexual assault
- Human trafficking
- Felonious assault
- Kidnapping
- Stalking
- Rape
- Witness tampering
- Extortion

Do I need a police report?
Yes, a police report or law enforcement record helps support your claim. You must also get Form I-918, Supplement B signed by a law enforcement agency, confirming your helpfulness.
Can I still apply if I’m undocumented?
Yes. Immigration status does not affect your eligibility. U visa applicants are protected from deportation while their case is pending.
Can I apply if the crime happened years ago?
Yes, as long as:
- The crime occurred in the U.S.
- You suffered substantial harm
- You were or are helpful to law enforcement
Who can be included in my application?
You can apply for certain family members:
- If you’re under 21: spouse, children, parents, unmarried siblings under 18
- If you’re 21 or older: spouse and children
Can I get a work permit with a U visa?
Yes. Approved U visa applicants receive work authorization and may qualify for certain public benefits.
How long does it take to get a U visa?
Due to the 10,000 annual cap, there is often a multi-year wait. However, eligible applicants may receive deferred action and work permits while waiting.
Can I get a green card from a U visa?
Yes. After 3 years of continuous presence on a U visa and continued cooperation with law enforcement, you can apply for a green card (I-485).
Is there a filing fee?
No. There is no fee for the U visa application or the associated waiver (Form I-192).
