T Visa – Frequently Asked Questions (FAQ)

What is a T visa?

The T visa is for victims of human trafficking (sex or labor) who are physically present in the U.S. because of trafficking and are willing to assist law enforcement in investigating or prosecuting the traffickers.

What is “severe trafficking”?

  • It includes:
    • Sex trafficking: Involving force, fraud, or coercion—or any commercial sex act involving a minor.
    • Labor trafficking: Using force, fraud, or coercion to obtain labor or services, such as domestic servitude, debt bondage, or forced labor.

Do I need to cooperate with law enforcement?

Yes, if you are 18 or older, you must show that you cooperated with law enforcement in a reasonable way—unless you were too traumatized.

Minors under 18 are not required to show cooperation.

Can I apply if I entered the U.S. illegally?

Yes. You may still qualify if you are a victim of trafficking and meet the other eligibility criteria. You can also apply for a waiver of inadmissibility using Form I-192.

What evidence is needed?

Evidence can include:

  • Personal declaration describing your trafficking experience
  • Police or court records
  • Medical or psychological evaluations
  • Statements from witnesses, service providers, or law enforcement
  • Optional: Form I-914, Supplement B signed by law enforcement

 

Can my family members apply with me?

Yes, eligible family members may receive derivative T visas.

If you’re under 21: spouse, children, parents, and siblings under 18

If you’re 21 or older: spouse and children

Other relatives may qualify in cases of retaliation risk.

Can I get a work permit?

Yes. If your T visa is approved, you automatically receive work authorization for the duration of the visa (up to 4 years).

Can I get a green card?

Yes. You may apply for a green card (adjustment of status) after 3 years on a T visa or once the trafficking investigation is complete—whichever comes first.

Is there a limit on how many T visas are issued?

Yes. USCIS can approve up to 5,000 principal T visas per year (derivatives not included in the cap). If the cap is reached, USCIS may grant deferred action and work permits until a visa becomes available.

Is there a filing fee?

No. There is no filing fee for the T visa or the waiver of inadmissibility.
