K-1 Fiance Visa Petition

Eligibility Requirements for a K-1 Visa:

A K-1 fiance visa lets the fiancé or fiancée of a U.S. citizen enter the United States on the condition that the couple gets married no more than 90 days later. For terminology purposes, the fiancé is used to refer to either a male or female partner who is engaged.

The sponsor must be a U.S. citizen.
The relationship between the couple must be proved through evidence such as but not limited to photos, emails or letters, statements, etc.
In addition, the couple must be able to provide evidence of them having met in person at least once within two years preceding the filing of the visa form. This requirement may be overlooked in certain extreme cases, such as in circumstances where physical meetings would violate social norms.
Both partners must currently be unmarried. Previous annulments, death certificates or divorce decrees must be produced to indicate the end of any previous marriages.
Both partners have to give a signed statement showing their intention to marry within 90 days of the fiancé’s arrival in the United States.
Income requirement for the partner who is a U.S. citizen: The adjusted gross income on their most recent tax return must at least meet the Federal Poverty Guidelines.
Note: If this is the only requirement that is unmet, a joint financial sponsor must provide an “affidavit of support.”

Step 1: File Form I-129F with the USCIS.

Proof of U.S citizenship for the fiancé:

Copy of fiancé’s passport
Evidence that proves the legitimacy of the relationship
Evidence that proves the couple met in person at least once within the past two years to file the form
Statements written and signed by each fiancé that describe the couple’s relationship and indicate an intent to marry within 90 days of the fiancé’s arrival to the United States.
A copy of a Form I-94 Arrival/Departure Record previously given to the fiancé who is being sponsored.
Two passport-style photos (one of each fiancé).
After all the documents are filed at the proper location, the USCIS will send a receipt notice usually within 30 days. Additionally, if more information is required they may also send a Request for Evidence, otherwise known as an RFE. Regardless, once the form is approved, the USCIS will send an approval notice.

Step 2: Completing form DS-160

After the I-129F fiancé sponsorship form is approved, the fiancé being sponsored will get a notice from the U.S. embassy located in their home country which will include the date and location of their interview as well as the required documents to bring. Afterward, the fiancé has to complete the State Department’s online DS-160 form. It’s highly advised to print the confirmation page once the form is completed.

The following documents are required by the State Department of the sponsored fiancé:

-Birth certificate
-Two passport-style photos
-Currently valid passport
-Police clearance from all countries the fiancé has resided in for more than 6 months since 16 years of age.
-A sealed medical exam form acquired from a physician whom the State Department has authorized.
-In addition, the fiancé who lives in the U.S must provide the following documents:
-Affidavit of support, otherwise known as Form I-134
-A copy of the approved I-129F package filed with the USCIS
Most recent tax returns.

Step 3: Interview.

The interview occurs typically 4-6 weeks after the embassy’s notice and takes place in the nearest embassy or consulate in the fiancé’s home country. The interview officer usually makes a decision on the same day, however, if they need more information, they will ask for it to be submitted to the U.S. Consulate.

Step 4: Arrival to the United States.

After approval of the K-1 visa, the fiancé is given 6 months from the approval of the I-129F form to come to the United States.
It is important to note that the couple must get married within 90 days of arrival, or else the fiancé will lose their K-1 visa. Additionally, the fiancé is required to leave the United States if the couple decides not to get married.
Note: The K-1 Visa cannot be changed to another temporary visa.
After marriage, the next step is to apply for a marriage-based green card.

What is a K-2 Visa?

A K-2 Visa is connected to the K-1 Visa process and allows for the fiancé(e) of a U.S citizen to bring their child/children to the U.S. However, the children must be under 21 and unmarried upon entering the U.S.

What is a K-3 Visa?

A K-4 Visa allows for the children of a K-3 Visa holder to enter the U.S. However, the children must be under 21 and unmarried upon entering the U.S.
