Reinstatement of F1 Student Status
How can I reinstate my F1 Status?
Reinstating F1 status is a process that allows a student to regain their valid F1 status if they have fallen out of status due to certain violations or circumstances. To apply for reinstatement to F1 status, follow these general steps:
- Consult Your Designated School Official (DSO):
- Schedule an appointment with your school’s DSO (Designated School Official) to discuss your situation. Your DSO can provide guidance on whether reinstatement is appropriate in your case.
- Determine Eligibility:
- Before pursuing reinstatement, make sure you meet the eligibility criteria, which typically include:
- You must have not been out of status for more than five months at the time of applying for reinstatement.
- The status violation must have been due to circumstances beyond your control or inadvertent.
- You must not have engaged in unauthorized employment.
- You must not have a history of repeated violations.
- Before pursuing reinstatement, make sure you meet the eligibility criteria, which typically include:
- Gather Required Documents:
- Work with your DSO to prepare the necessary documentation, which may include:
- Form I-539, Application to Extend/Change Nonimmigrant Status.
- Form I-20, updated by your DSO to reflect your request for reinstatement.
- A personal statement explaining the circumstances that led to your out-of-status situation and the steps you have taken to rectify it.
- Financial documentation to prove you can financially support yourself during your reinstated status.
- Any other documents as advised by your DSO.
- Work with your DSO to prepare the necessary documentation, which may include:
- Pay the Reinstatement Fee:
- Pay the required filing fee for Form I-539, as indicated on the USCIS website.
- Submit Your Application:
- Mail the completed Form I-539, along with all required supporting documents and the application fee, to the USCIS lockbox facility as instructed on the USCIS website.
- Await USCIS Decision:
- USCIS will review your application. The processing time can vary, but it often takes several months. Continue to maintain your status while your application is pending.
- Attend a Biometrics Appointment (if required):
- USCIS may require you to attend a biometrics appointment, where they will collect your fingerprints, photograph, and signature.
- Receive USCIS Decision:
- USCIS will notify you by mail of their decision. If your reinstatement is approved, you will receive an updated Form I-20 reflecting your reinstated status.
- Maintain F1 Status:
- Once reinstated, make sure to maintain your F1 status by attending classes, complying with the terms of your visa, and keeping your documents up to date.
- Update SEVIS Record:
- Your DSO will need to update your SEVIS record to reflect your reinstated status.
Please note that reinstatement is not guaranteed, and USCIS will carefully review your case. It’s crucial to work closely with your DSO throughout the process, provide accurate and complete documentation, and demonstrate that you meet the eligibility criteria and have a valid reason for your status violation. Consulting with an immigration attorney may also be helpful if you have specific concerns about your case.
